Massachusetts unions and school districts are challenging President Donald Trump’s executive order to dismantle the U.S. Department of Education in a lawsuit filed on Monday.
The lawsuit filed in the U.S. District Court for the District of Massachusetts by Democracy Forward, claims the administration is acting unlawfully and will have a drastic impact on students.
Plaintiffs include Easthampton and Somerville public school districts, the American Federation of Teachers, the American Association of University Professors, the American Federation of State, County & Municipal Employees Council 93 and the Service Employees International Union.
“Protecting access to public education is an important component of ensuring all children have the opportunity to succeed — a value most Americans hold dear and one that is crucial to our democracy. For nearly 50 years, the federal government has helped us ensure equal access, especially for those who have had access restricted throughout history — including low-income students in rural and urban areas, students with disabilities and students learning English,” Jessica Tang, president of the American Federation of Teachers Massachusetts, said in a statement.

Madi Biedermann, deputy assistant secretary for communications at the U.S. Department of Education said in a statement to MassLive that the litigation is wasting the department’s resources.
“Instead of focusing on the facts and offering helpful solutions to improve student outcomes, the union is once again misleading the American public to keep their stranglehold on the American education bureaucracy. The union is also forcing the Department to waste resources on litigation instead of the programs the union claims to care about and the kids this Administration is fighting for,” Biedermann said.

They don’t have any “standing”.
BINGO! You get huge amounts of cash but have atrocious results to show for it.
What Billy said.
We need legal reform, for many, many reasons. I have almost no faith in our system as it currently exists.
Are you a judge?
/S
If they could prove any benefit from the DoE, they’d have a better case.
But they can’t.
Too bad, so sad.
Don’t like it? Secede to Canada (you’ll be reabsorbed into the Union soon enough along with the other provinces).
No. They wouldn’t let me in law school because my parents were married.
They don’t have any “standing”.
That only gets used against Republicans who have had elections stolen from them.
Well...they are demonsrating their worthlessness and failure at math (and taxes). Their results over 40 years SHOULD BANKRUPT them.
Lawfare lawsuit number .... ad nauseam.
Look what’s coming outta “Messachusetts” now...
Dismantling Dept of Education is another Trump best. Thank you! Hope he does the same with Dept of Energy. Their role in the past hasn’t measured up.
And what standing would the Union have for this suit with the court?
Honestly this stuff is getting ridiculous.
Exactly... what possible standing could this Teachers Union have in this?
Guess who the board chairman is for Democracy Forward (NGO lawsuit filer)? Marc E. Elias. Surprise!!!
