‘A Chilling Effect:’ Central New York County Faces Federal Threats for Not Complying with ICE

The Trump administration, eager to force local officials to collaborate with ICE, is coming for a Tompkins County sheriff who released a man who’d served his sentence. Central New York’s Tompkins County, home to Ithaca, found itself in the federal government’s crosshairs last month when the Trump administration made the county a focal point of the president’s push to force localities to dedicate resources to mass deportations.

Sheriff Derek Osborne did something routine: He released a man from jail after he’d served his sentence. But Immigration and Customs Enforcement wanted Osborne to hold the man, an undocumented immigrant, past his release date so the federal agency could arrest and deport him.

The US Department of Justice is now investigating and threatening to prosecute the sheriff for failing to cooperate with ICE, though it’s not clear what the department would charge him with.

The sheriff’s office said Osborne “acted consistently” with state and local policy, didn’t interfere with federal law enforcement, and told ICE when the man was going to be released. “From what I can tell, the sheriff did not violate any law,” said Estelle McKee, a professor at Cornell Law School in Ithaca who specializes in immigration.

The problem is breaking the law, and that’s going to stop.

LOL “served his sentence”. But nothing about the charges of illegal entry, no?

The military had a very simple solution for this. If you had him in your custody and he escapes (or you let him go), you sit in the cell until he’s re-apprehended.

If it had been the Biden White House that asked for the man to held he would have been held but since it was Trump…no dice.

Ithaca is the home territory of Ithaca College and Cornell University and is the center of mid-State Liberalism.
Hochul still believes that NYS is a Sanctuary State and doesn't have to comply with Federal policy or Laws.

Arrest him and charge him with acessory after the fact for openers.ICE made him well aware of other harges pending against his prisoner. The shock of this assinine sheriff in cuffs, thrown in a jail and then spending money on legal fees will get their attention.

Maine is about to lose fed funding due to its stated intention to keep troons in womens’ sports.
Notice how easily they can segue from “preemption!” to states’ rights!”

The illegal alien was in the custody of the sheriff. The sheriff housed the illegal alien. Supporting, aiding or housing an illegal alien is a violation of federal law. Seems like a simple federal conviction.

I want to see some real punishment against people who flout the nation’s laws. Not just penalties and firings, but actual sentences and/or incarceration. Make an example of them and things will quickly change.

[“Local law enforcement officers are free to decline to engage in immigration enforcement,” said Amy Belsher, a senior staff attorney at the New York Civil Liberties Union who focuses on immigration, “and in fact under certain circumstances are required to decline from doing so under state law.”]

I thought the Obama admin made it clear that state governments cannot implement their own immigration laws? Arizona simply wanted to mandate enforcement of federal law and had its keister kicked in court. Meanwhile, my home state flouts federal law entirely by granting asylum to basically everyone, which only the federal government should be able to do.

How duplicitous.

Clearly we need more ICE agents as they should have been there waiting outside to detain the man.

Update. Local enemedia trying to spin, but the details are damning. Notice that the name if the county, Tompkins, is left out if the headline. I'm sure the purpose of that is to screw with online searches.

Why an undocumented immigrant's criminal history in CNY has no bearing on immigration case

BTW, be sure to read the 12 comments.

No, we didn't vote for this. Possibly not even Tompkins.
