Judge allows federal worker "buyout" plan to proceed; applications are closed

Boston — A federal judge in Massachusetts allowed the Trump administration's bid to offer "deferred resignations" to federal workers who voluntarily leave government service to continue and lifted a previous court order pausing the program's deadline.

Judge George O'Toole, in the U.S. District Court for the District of Massachusetts, ruled Wednesday that the plaintiffs in the case — unions that represent federal employees — lacked standing to bring the case in the first place. He also ruled he did not have the jurisdiction to stop the program from proceeding.

The judge initially paused the original Feb. 6 deadline for workers to accept the offer last week, and held a hearing on Monday over whether he should issue a temporary restraining order extending the pause.

OPM spokesperson McLaurine Pinover said in a statement Wednesday that the office was "pleased" with the court's decision and that the deferred resignation program was closed as of 7 p.m. Wednesday.

Do union reps think their members could not access the agreed retirement? I’ll bet there are some who are pissed that they jerked around, and 7:00 today came.

Maybe the ‘judge’ should have realized he didn’t have jurisdiction before he opened his big fat mouth in the first place?

I have no doubt that he did - he just didn't think he would get called on it AND THEN OVERTURNED!

A lot of folks will be very pissed off at the unions, having delayed the choice the first time when the injunction went into effect and the deadline was moved from a midnight deadline last week to a midnight deadline on Monday, then the decision very late today and instead of another midnight deadline it was immediately closed. Snooze you lose.
They probably would have a lot of last minute deciders once it was clear the plan would go forward. Oh well, now the layoffs will begin.
I know some very good people who took the offer. Had taken jobs pre covid with telework available a couple of days ago a week so it took the sting from commuting a couple of hours every day. Some, not all, but some jobs can be efficiently done from a home office. Production is the key
