Daniel Penny, the veteran who used a chokehold on subway rider Jordan Neely, has been acquitted in Neely's death.
Jurors acquitted Penny of criminally negligent homicide, which could have put him behind bars for up to four years, in Neely’s chokehold death aboard a crowded uptown F train in May 2023, The New York Post reported.
Manslaughter, the top charge against Penny, was tossed on Friday after jurors twice said they couldn't reach a unanimous verdict.

So, the juror(s) who held out for convicting Penny of manslaughter have now capitulated on the lesser charge?!
Shocking in a good sort of way — hard to believe a NYC jury did the right thing.
So, the jury deadlocked on the more severe charge, but acquitted on the lesser charge. Very strange, but great news.

Neely was a threatening menace to the public and had no business wandering around but NYC is awful about letting these cretins run free. Neely was responsible for choosing poorly and paid the consequences. Sad that he lost his life in the process but its on him.
Don’t think Daniel Penney is anywhere near out of the woods as the family has files multi-Civil lawsuits for wrongful death and a host of other suits against him and the Civil side is easier to prove...He may win the battle but lose the war..

“We’re devastated, upset, angry, hurt,” Mills said, flanked by Neely’s father, Andre Zachery. “Jordan Neely was choked to death by someone who didn’t care people was telling him to stop. Last week the jury was — they couldn’t decide on the top charge but they come back his week and they give up on us.”
“The district attorney did a good job,” Mills added. “The jury in this case let us down.”
Last week, Zachery filed a civil suit against Penny, accusing him of negligent contact, assault and battery in Neely’s death.
“I miss my son,” Zachery said. “My son didn’t have to go through this. I didn’t have to go through this either.”

These will bankrupt him and judgements will ruin him plus interfere with his employment..
Unusual, yes, however not strange, if you consider that one or more Informed Jurors may have Tactically deliberated and voted.
