The case brought by the district attorney of Fulton County could stretch past Trump’s inauguration, auguring a constitutional clash.
When President-elect Trump takes the oath of office on January 20, the Constitution ordains that he “shall have Power to grant Reprieves and Pardons for Offences against the United States.”
That has been taken to cover federal crimes, but not state ones — like the ones brought by the district attorney of Fulton County, Fani Willis. She charged Trump and 18 others with racketeering and other crimes against the Peach State in connection to efforts to reverse the result of the 2020 presidential election.
The prosecutions of Ms. Willis and of the district attorney of Manhattan, Alvin Bragg, have, alongside Trump’s victory in November, opened up hitherto unexplored constitutional terrain: Can a president be prosecuted for state crimes while in office? The answer to that question could determine the fate of Ms. Willis and Mr. Bragg’s cases — and the scope of the protections of the presidency.
Pardons for state crimes usually reside within the purview of the highest executive authority in the state — the governor. Georgia is led by Governor Kemp, a prominent Republican who has had a fraught — to put it mildly — relationship with the 45th president, now the 47th president-elect.
Mr. Kemp opposed President Trump’s efforts in 2020 to overturn President Biden’s win in Georgia, and the president-elect backed his opponent two years later. He also called Mr. Kemp a “disloyal guy” and a “very average governor. … Little Brian, little Brian Kemp, bad guy.” The two let bygones be bygones this year, when Mr. Kemp endorsed Trump — and Georgia swung Republican.
Even if Mr. Kemp was moved to pardon Trump with respect to Ms. Willis’s prosecution, Georgia law

Supremacy clause, anyone?
That’s alright, Kemp. You don’t have to pardon Trump, and Trump doesn’t have to give you a pass on all the ways in which you aided and abetted the theft of the 2020 election.
My bet is Kemp blinks first if it even comes to that.
AND THERE’S THIS IN COUNTERPOINT

Death throes.
They both had to fabricate the "crimes" they are attempting to prosecute.
Trump was NOT trying to overturn the election. He was trying to prove illegal moves to pad the votes.
And here is why the author’s thesis is so wrong:
Mr. Kemp opposed President Trump’s efforts in 2020 to overturn President Biden’s win in Georgia...
When your premises are lies, you miss what is possible. If, as this joke of a journalist claims, Trump lost fair and square, then Trump would indeed have little leverage over Kemp. But if, on the other hand, Trump had the election stolen from him and Kemp was complicit...
So if/when Kemp pardons Trump, this clown will be scratching his head trying to figure out how it could have happened just as Democrats today are still puzzled as to why Harris lost.
Koko the Gorilla had a higher IQ than both of them combined. Even though Koko has passed on,
she still has a higher IQ than Farnia and Buckwheat.
Fani’s big butt needs to be thrown in jail.
Throw big Fani in prison to do the time. President Trump is busy right now.
define ‘nearly’ unpardonable,
The jag off that wrote this article doesn’t realize one thing in 26 John Ossoff is up for re-election in a state Trump won by alot does this guy really think Kemp who can practically smell that senate seat wanna piss off MAGA voters of the sitting President of the United States?
This is a big reason, not the only reason but a big one, that the Trump administration needs to expose the 2020 fraud. Obviously at this point it can’t been undone, but the false talking point that Trump tried to overturn a fair and honest election needs to be utterly destroyed, overwhelmingly and publicly.
So even if there are no arrests, the exposure is absolutely vital. And of course, there should be arrests, but just the exposure alone would go a long way towards breaking the back of the Deep State and waking up those who have bought the lies.
Rat-burger has been babbling recently about how in 2020 there were a lot of mail in ballots “that were hard to manage”—already making excuses for the fraud.
The writer of this article is wish casting as the charges would get overturned on appeal as it involves a federal Rico statute which she had no authority to bring anyway
