Rio Rancho man awarded $400M in medical malpractice lawsuit

RIO RANCHO, N.M. – A jury just awarded a Rio Rancho man with what could be the largest medical malpractice verdict in history.

The Rio Rancho man ended up suing NuMale Medical Center at Wyoming and Paseo because of what he’s gone through and lasting medical consequences.

According to the lawsuit, the physician assistant in this case is Steven Chapman. The victim – Michael – told Chapman he was interested in testosterone replacement therapy to improve his energy and a medically managed weight loss plan.

But according to the lawsuit, Chapman brought up erectile dysfunction. Even though Michael said he was not interested in ED treatment, Chapman told him it was designed to work with the testosterone replacement therapy.

Ultimately, Michael purchased a plan which included testosterone pellet implants in his butt and at home penis injections.

When Michael felt the medications weren’t working, he went back to the office. The lawsuit states Chapman said Michael wasn’t doing it right, demonstrated the penis injection, and sent him home with a medically induced erection.

“This physician assistant injected the chemical into his penis because he couldn’t figure out how to do it, and he injected 75% more of the chemical and a stronger dose than he should have, and sent the patient home and said ‘Go show all your friends.’ This is what he said to a 66-year-old man,” said Nicholas Rowley, Michael’s attorney.

The lawsuit states Michael couldn’t get rid of the erection over the weekend and went back to the clinic. Medical staff tried painful and embarrassing procedures to help Michael, but it didn’t work.

Chapman reportedly told Michael to drive himself to the emergency room where he had emergency surgery. But the damage was done.

“His penis is dead. It’s actually, what it is now is it is much smaller than what it was, and it’s just a lump of scar tissue that doesn’t work in any way shape or form,” said Rowley.

Rowley says the urologist who treated his client claimed he’d seen cases like this before. But the close to half a billion dollar verdict will keep it from happening again.

New Mexico seems great for large verdicts. Does seem like real malpractice, though. Not just a medical mistake. Plaintiff wasn't interested in ED therapy, but they convinced him it would help with something else. Then the physicians assistant gave him an injection in the penis with more than the proper dose. He had an erection for 2 days and then his penis didn't work at all.

This is just wrong. Wrong. Penile injections. Pellets in the butt.

I can’t believe I read that whole thing.

First of all, I don’t know why a physicians assistant was handling this. And if an erection lasts longer than 4 hours, a trip to the ER is necessary. Whoever he called should have told him to go to the ER ASAP.

“Now,go show all your friends!!” ..said the doctor.

**The victim definitely deserves a decent settlement of some kind, but that amount seems quite excessive.
Not to mention, none of those millions will bring Woody home again, anyway.
Apparently, our legal system still places a very high dollar value on male sexuality, diminished though it be.

It’s a corporation, and they can pay $100K for a PA versus $250K for an MD. It seems like definite malpractice in several different ways. Obviously, verdict amount is ridiculous. The jury probably thought it was sending a message to the company.

Words you really never want to hear when you wake up from anesthesia: “It’s dead. It’s just a lump of scar tissue now.”

Chapman said he was interested in ‘testosterone replacement therapy’ to improve his ‘energy’ and a medically managed ‘weight loss plan’.....

When the Dr. mentioned ED treatmet that should have given him a heads up immediately to ask for a second opinion.

The minute pellets in the butt, and needles in the junk were proffered as a treatment. I would have been out door faster than you could say Jim Robinson.

You’re probably right.
The payoff was pretty steep for a shriveled penis.
But I don’t think he can pee out of it anymore and then had to have a urostomy which is a whole in the bladder that empties through a tube into a bag.

One could assume this will be appealed.

Counter of diagnosis?

If the PA was female.

There are too many practices where PAs see patients and the supervising physician rubber stamps their clinical decisions and treatment plan - without ever seeing the patient.

I’d be surprised if the appellate court didn’t massively reduce that amount.

I believe the legal euphemism is “loss of consortium”.

This is New Mexico where like only one other state (Hawaii) has a receipt’s tax on medical services, which essentially comes out of the Doctors’ income. Net result is horrible medical services as doctors leave regularly. Very hard to find a GP accepting new patients, many months later o get an appointment and then most likely will be seen by a staff person, normally a CNP or something less than a Doctor. Some of the practices are truly horrible but the demand is so great they survive. Until a judgement like this happens.

I agree! I’ve never worked with a PA.
