Donald Trump floats workaround if Senate won’t confirm AG pick Matt Gaetz (ACTING appointments with NO confirmation necessary)

There’s more than one way to install an Attorney General.

President Donald Trump is suggesting on social media that if the Senate won’t confirm Matt Gaetz as the next Attorney General, Trump will go an alternate route.

Trump could use the Federal Vacancies Reform Act of 1998 instead of the recess appointment process, which has also been floated to get the Panhandle Republican through a Senate where many Republicans are skeptical of the Gaetz pick.

That 1998 law allows for temporary appointments.

“If no one has been nominated to the position, an acting officer may serve in the position for no longer than 210 days beginning on the date of the vacancy. However, for any vacant positions that exist during the 60-day period beginning on a transitional Presidential inauguration day, an acting officer may serve in the position for no longer than 300 days beginning on the inauguration day or the date of the vacancy,” an FAQ reads.

Hot Damn! About time. I’ve been saying use this ever since Trump appointed Richard Grenell acting DNI and it worked out perfectly.

It’s simple. Get a corral of “acting” talent and rotate them in six month shifts around ALL the agencies. Gaetz as AG and Grenell at CIA for six months, then flip flop them. Work in Flynn, Fitton, anyone into the rotation.

When will people realize, recess appointments are wins. Getting a person in the office is a win. It's like Executive Orders aren't wins.

If the Democrats were smart, they would confirm Gaetz as soon as they could. Have someone with three years low level legal experience as U.S. AG is a massive win for them.

In addition you can appoint anyone as a “Special Advisor” to the cabinet officer and just let it be known to the cabinet official that the “Special Advisor” makes all final decisions.

The cabinet officer can just be a front person to sign documents.

There are many ways to get actions done.

(In many federal agencies the heads of the agencies are political hacks and the real power lies with subject matter experts who are not subject to Senate confirmation.

The agency head is the person who testifies to Congress and reads information they are given.

That is why so many Senate and House hearings sound so stupid. The agency heads are often clueless.)

Unfortunately we are not in Kansas anymore. The establishment GOP hates Trump and are going to do everything they can to block his agenda. They will be pulling rabbits out of the hat before this is over.

Trump could easily say he himself is the attorney general and that Gaetz will be his special assistant. As president, Trump is already the head of the justice department and all other departments.

If you’ll recall, Trump wanted John Ratcliffe as DNI. McConnell wouldn’t even schedule hearings for him. Trump named Grenell acting DNI and Grenell started declassifying and releasing DS secrets! McConnell couldn’t get Ratcliffe confirmed quickly enough.

Do acting heads on all agencies the swamp refuses to let Trump have his picks. Six months of Gaetz, Grenell, Flynn, Fitton, all their worst nightmares, then Trump will then get his way.

There are going to be several thousand appointments for the Senate to deal with....

The vast majority will be approved.

Those that are not can be worked around in ways discussed in this and other threads.

This is much ado about nothing.

Think about how much mass media coverage Liz Cheney got this election cycle.

She called President Trump every name in the book—and actively campaigned for Harris.

It all amounted to nothing.

Another example—millions of words about the Nikki Haley primary campaign.

All for nothing.
