An explosive, anonymous letter has shaken the legal departments in the US, alleging a conflict of interest at the heart of Houston’s bankruptcy court. The letter, which surfaced in March 2021, accuses US Bankruptcy Judge David R Jones of maintaining a romantic relationship with Elizabeth Freeman, a prominent attorney at Jackson Walker and co-counsel for Kirkland & Ellis in billion-dollar cases overseen by Jones, reported The Wall Street Journal (WSJ). According to WSJ, the allegations suggest that Freeman’s involvement in cases before Jones was influenced by their personal relationship, potentially compromising the impartiality of court rulings affecting numerous stakeholders. Known for his favourable decisions towards firms like Kirkland, Jones’ tenure as Houston’s chief bankruptcy judge significantly elevated the court’s profile.

Corporate bankruptcy and reorganization Chapter 11 trials have largely moved to Houston from NY and Del.

Judge David R Jones assigned the great majority of trials to himself and a former law partner Marvin Isgur.

A great many of the firms seeking Chapter 11 were represented by the law firm Kirkland.

Kirkland attorneys met with Jones prior to moving cases to Houston.

Kirkland partnered with a local firm Jackson Walker and its attorney Elizabeth Freeman.

A disgruntled investor Michael Van Deelen received an anonymous letter alleging that Elizabeth Freeman was having an affair with Judge Jones. He sought to have the matter investigated.

The letter was quashed by Jones's partner Isgur, removed from public record by Jones.

Jones denied the affair.

Van Deelen is a persistent sort, got turned down by more judges, integrity of the court, harrumph.

The Van Deelen found out that Jones and Freeman owned a house together, and slowly, slowly, the investigation is opening up...

Fani is wishing she’d figured out how to be even more corrupt. All she got was a few vacations and a gigolo willing to boink her.

She earned her partner’s share at the firm. Looks like she’s a solo practitioner these days.

Knew of a bankruptcy judge in another state that got caught as a peeping tom. His mistake was that when the trash can he was standing on fell over and made noise, instead of running off, he climbed back on. Unfortunately for him, the residents heard the noise and called the cops. He turned up as a partner in a big city law firm in another state.

As reported yesterday in Bloomberg Law:

Legal heavyweight David Boies will represent a former Texas bankruptcy judge accused of improperly concealing his romantic relationship with a local attorney.

Boies, chair and founding partner of Boies Schiller Flexner, entered an appearance on Wednesday on behalf of the former judge, David R. Jones, in a civil suit brought by the former CEO of petroleum barge company Bouchard Transportation Co. Inc.

Jones’ hiring of Boies, the famous litigator whose firm has worked for disgraced Hollywood mogul Harvey Weinstein and controversial Theranos chief Elizabeth Holmes, is the latest development in the scandal related to Jones and his once-secret relationship with Elizabeth Freeman. She was Jones’ former clerk and a onetime partner at Jackson Walker, a law firm that regularly represented clients before him in court.

He was an excellent judge. His former firm has a great reputation in trial and appellate work. I’ve appeared before him. All men have clay feet.

I take it that bankruptcy trials are a specialty even for a judge and not every judge will have enough expertise and experience?

Still it seems unbalanced that he and Isgur were hearing so many of the nation’s big corporate Chapter 11 cases.

Corruption is the new “integrity”. If you aren’t corrupt (or corrupt-able) something is “wrong” with you. What a criminal Clown World. A cataclysm may (unfortunately) be the only way out.
