That is the major problem. Case in point: had a contract litigation brought upon “fraud” grounds relating to the sale of a house in an HOA. The buyer ran a plumbing business and wanted to park his UPS-style step van that he used for work in the back yard. After the sale the buyer sued my seller/client. The “fraud” was that the seller failed to advise the buyer the HOA prohibited (1) routine parking of commercial vehicles and (2) off street parking. They demanded $1million! on a house purchased for about $500k.

I tried and tried and tried to get them to drop it; they refused. We won and obtained a $90K+ fee award.

They won’t be suing for bullsh*t again, I guarantee it. No such sting is felt when the gov. does it, so they do it over and over again because, why not? It’s not their money!
