Plays into the hands of the leftists who hate SCOTUS.

It will be so sad when they cry.

And it's especially good to have them loudly on the record as hating an entire branch of our government that was created by our Constitution and shaped by multiple Presidents from both parties--and which, for better or worse, is revered by the vast majority of Americans.

I somewhat agree that this doesn’t have to do with Trump. It has more to do with a “system” that would allow this crap to go this far.
From Russian collision to bogus impeachments to this.
I’m glad you trust the process...which there isn’t a spread of evidence it’s working..to now month away from a presidential election for fairness or the system to prevail.

I know I said it was my last post - but what have I done wrong to make you think I “trust the process”.

I have >68,000 posts here since 1998 and I don’t believe any of them sound like a guy who trusts the process.

Was it a mess when Trump raised a quarter billion dollars in three days after the verdict?

Was it a mess when he gained 3 million tik tok followers in the same time?

Not to mention that everyone sees the fraud in our court system. Don’t underestimate the power in this accomplishment.

Your original post sound like you were making a plea for the ny appeals court to run it’s course.. paraphrasing
But there isn’t any time to waste.
Again, a presidential election is months away.

..they are wasting his time and money.
And his opponent is all for it.. cause all he cares about is getting re-elected any means possible.
Again...never a situation like this in the history of America.

The problem is that there is no federal common law. The All Writs Act, 28 USC § 1651, authorizes then Supreme Court and other federal courts to “issue all writs necessary or appropriate in aid of their respective jurisdictions and agreeable to the usages and principles of law,” but that does not confer any additional jurisdiction on the Supreme Court.

SCOTUS’s jurisdiction here is limited to: (1) appellate jurisdiction to hear a petition for certiorari from a final judgment of NY’s highest court, the NY Court of Appeals; or (2) jurisdiction to hear an original petition for habeas corpus if (and only if) Trump is in “state custody.” There is no jurisdiction yet because (1) the case hasn’t even been heard by, let alone ruled on by, the NY Court of Appeals; and (2) Trump is not currently in state custody.

As I’ve said elsewhere, Judge Merchan can effectively preclude any SCOTUS review of this case before the election by simply allowing Trump to remain free pending his appeal. Of course, since he’s proven he’s a political actor, whether he does so probably depends on what he thinks will politically benefit Biden and the Democrats most: Denying Trump the chance at vindication through reversal of the conviction, or the spectacle of SCOTUS potentially stepping in to keep Trump out of jail (which they’ll use to further attack SCOTUS’s legitimacy).

What, about this specific case, REMOTELY gives the USSC jurisdiction before NY appeals are done? Nothing, is what.

There is no requirement in the U.S. Constitution that says that things must flow up through a series of other courts before heading to the Supreme Court.

The Constitution clearly sets that the Supreme Court is the ultimate court in the land. Nothing in there says it can't pick a case...they just choose not to do so until it's run a gauntlet.

It is also interesting that Article 2 of Section states, "In all Cases affecting Ambassadors, other public Ministers and Consuls, and those in which a State shall be Party, the supreme Court shall have original Jurisdiction." If a former President doesn't count as a public minister, who does?

HAVING to go through lower courts before being heard by the SC, just sounds like more legal made-up nonsense...similar to 'qualified immunity'.

A State is a party. They have original jurisdiction,
that's a fact. But it's rare. SCOTUS decides whether to exercise it.

Say scotus rules in his favor but he then loses in Nov.

You will see the SCOTUS eviserated. Probably stacked with X new leftist seats and weakened in how many more ways??
