I agree with him that the NYC 1st judicial division appellate court will not overturn it. There are all Dem judges sitting on the court. He has a little better chance with Court of Appeals in Albany. His best chance is if he can get the US Supreme Court to accept review after he exhausts his NY appeals, he will get it reversed because it is a much more friendly forum and he has the law on his side.
