Brennan said that Merchan treated him (Brennan) fairly on a different case: “He was a gentleman, he is smart, he works hard, and I really don’t — it’s above my pay grade to get into political issues. I have no political agenda.” Brennan also said that Merchan and the prosecutor were “pros.” I don’t know if he was in the courtroom or how closely he was following the case.
Brennan faced off against Steinglass, the prosecutor, in one of his cases. One lawyer can admire another’s competence in putting forward his case in a professional way without approving of the case that lawyer puts forward. Maybe some of that attitude spills over into Brennan’s opinion of Merchan. Being in control of the courtroom may make more of a positive impression on Brennan than being fair.
