Well no matter what happens in this trial, the defense has pretty much cornered the Judge and Prosecutors into a situation where any conviction will be quickly reversed on appeal. If the Judge approves the Jury Instructions and still doesn’t lay out the actual crime, then instant appeal win because Trump was convicted of...well...nothing. However if the judge DOES lay out the law Trump supposedly violated, “Conspiracy to Influence an Election” then the defense still wins on appeal because under New York law that provision only applies to state races and specifically excludes candidates for federal office.

Thanks for the analysis. I’ve wondered throughout this why this glaring missing underlying crime can wait to be revealed in the jury instructions? Doesn’t it have to be front and center right awaay as a right of the defendant?
