HOUSTON, Texas (KTRK) -- Investigators are working to find out if charges will be filed against a man accused of shooting two customers over a waitress' stolen phone on Saturday.
The Houston Police Department said the incident unfolded at a sports bar along Lyons Avenue and Boyles in the Denver Harbor area.
Just before 2 a.m., a waitress reportedly noticed her phone had been stolen from behind the bar where two men were drinking together.
Police said a manager looked at surveillance video showing one of the two customers at the bar had taken the phone.
That's when the woman decided to call her boyfriend and confront the customer.
"She confronted him and said, 'Hey, please give me my phone back.' He wouldn't do so. He lied and said he didn't take it. At that point, she called her boyfriend, who was close by - he's the individual who did the shooting. He comes over to this location and confronts the two males or the one who supposedly took the phone, and they actually get into a physical tussle," Lt. R. Willkens with HPD said at the scene.
Willkens said the boyfriend grabbed a gun out of his car and started hitting the man who allegedly took the phone.
"The other male comes out of the bar - comes out and tries to help his buddy. They're both fighting the one male with the gun - who is the boyfriend - and he ends up discharging his gun twice, hitting one in the torso and the other one in the torso," Willkens said.
The two customers who were shot are expected to survive, according to police.
Authorities said the shooter and waitress stayed at the scene and cooperated with officers.
Investigators will talk to the district attorney's office to determine if charges will be filed.

I couldn’t wait to get to the bars on Airline Dr. and managed to start drinking in those Houston bars 4 years before it was legal for me, I loved it, talk about developing situational awareness and good habits, for instance after fighting a guy and he was kicked out, I always made sure to exit the back door when I left because waiting for you outside with his car gun was a common occurrence.
Having bar bathroom preferences became second nature, the toilet tank lid, the loose towel dispenser on the wall, something, anything that was usable if needed.
I was always amazed how in California they just kept the order of who was next on the pool table instead of fighting for it, in fact in California the pool table was just for pool and no one ever fought over anything, much less stabbing and shooting guys, there was always about a 6 month decompression period when I would shift from Houston to California.
Well she didn’t prosecute the Hispanic that shot the Black robber as he was leaving the taco shop (finishing him off as he lay helpless on the ground), so there is hope for the shooter if he isn’t white.
I knew an illegal in the late 80s Houston that I didn’t like but we took him with us drinking a few of times.
The first night he went with us to an illegal bar we walked in, sat down, and his hand slid down to his boot and he pulled out a full sized sheath knife, I asked what in the dickens he was going to do with that since we had only been there for about 90 seconds, and he looked at a total stranger and said he had to kill him (for a look or something, I had missed), we had been there about 2 minutes and hadn’t even ordered a beer yet and this illegal was already a minute away from killing another illegal.
We left immediately and after a few more associations, we just quit taking him out with us.

If you kill someone for property be prepared to prove to a jury (possibly the same color as the thief and not you) that the property you killed that human over was worth more than the human thief who did not have a weapon

Of course not. Though there would be some small chance the PO would turn up, I believe that “Boyfriend” is less likely to be charged if he could show that they begged the police for help, but he was forced to act because they didn’t show.
