Hur must be “surprised” that Biden-—who Hur said a jury would perceive as “a sympathetic, well-meaning, elderly man with a poor memory,” and thus be unlikely to convict -——is a confident eager debater, even meticulously setting the debate terms, appealing to voters who are anxious to reelect “an elderly man w/ a poor memory.”

IIRC Hur was making a reference to Biden’s mental capacity at trial based on not prosecuting him until the hypothetical end of his first or second term, either option guaranteeing years of delay. Pathetic reasoning but he was subtly trying to avoid a current diagnosis of Biden and assuming further mental deterioration.
