Not quite the case. In a special session of the Maryland Legislature held April 1861 the vote was 53 to remain in the Union and 13 to secede from the Union. The next regular session of the Maryland Legislature met September 1861. It was at this time about 1/3 of the legislators were arrested by Federal authorities.
Same result— one cannot know how the 1/3 would have voted since they were detained. This was a highly illegal act to arrest state legislators. You know this and argue minutiae of a vote... not addressing the illegality of the act. Not in time of war, mind you. Prelude to Secession by State.
