That pretty much nails it! It is fairly unknown the effort Jack Smith made to avoid having Judge Cannon assigned to his prosecution; he and Jay Bratt, DoJ/FBI, knew that to pull off their scam they needed a sympathetic judge. Someone in the Southern District of Florida understood their ploy and assured that Cannon was assigned.
Judge Cannon might have grounds at this point to dismiss the case, my legal knowledge does not extend that far. But would Smith appeal for another judge - OR try to transfer the case to a D.C. trial judge? I think You are correct - Judge Cannon can keep delaying prosecution until it does not effect the November election, giving the appearance that she is fairly dealing with the issues of both sides.
Smith has maintained a D.C. grand jury for obvious reasons {indicting a ham sandwich}, just to establish an end run around Judge Cannon. I originally thought that she might order that grand jury shut down; instead she has patiently tolerated this somewhat unusual procedure.
Smith would probably like to transfer at least some of the case to a D.C. trial judge where he can easily have Donald Trump found guilty of espionage and mass murder; I suspect that he knows that Judge Cannon is prepared to deal with that loop hole.
Rumors about Smith working for the ICC and his reason for being severed from his prosecutorial duties include suspicion that he was blackmailing some of his investigative targets in return for which he would withhold evidence that might be used against them.
