No, he was charged with falsification of business records in the first degree, penal law 175.10. That is the actual crime.

We both know it’s a BS charge, but to say he wasn’t charged with a crime is just stupid.

I see what you meant. The 175.10 charge depends on the commission of another crime. That is what they have not explained, the "other crime," and my opinion is that holding a trial based on that is legal sophistry, just to confuse a NY jury into "convicting Trump of a felony" in an election year. Unfortunately, the penalty for malicious prosecution in NY does not include jail time.
