Supreme Court to consider when doctors can provide emergency abortions in states with bans

WASHINGTON -- The Supreme Court will consider Wednesday when doctors can provide abortions during medical emergencies in states with bans enacted after the high court's sweeping decision overturning Roe v. Wade.

The case comes from Idaho, which is one of 14 states that now ban abortion at all stages of pregnancy with limited exceptions. It marks the first time the Supreme Court has considered a state ban since Roe was reversed.

The Biden administration argues that even in states where abortion is banned, federal health care law says hospitals must be allowed to terminate pregnancies in rare emergencies where a patient's life or health is at serious risk.

Idaho contends its ban has exceptions for life-saving abortions but allowing it in more medical emergencies would turn hospitals into "abortion enclaves." The state argues the administration is misusing a health care law that is meant to ensure patients aren't turned away based on their ability to pay.

The Supreme Court has allowed the Idaho law to go into effect, even during emergencies, as the case played out.

Doctors have said Idaho's abortion ban has already affected emergency care. More women whose conditions are typically treated with abortions must now be flown out of state for care, since doctors must wait until they are close to death to provide abortions within the bounds of state law.

Meanwhile, complaints of pregnant women being turned away from U.S. emergency rooms spiked after the Supreme Court overturned Roe v. Wade, according to federal documents obtained by The Associated Press.

Anti-abortion groups blame doctors for mishandling maternal emergency cases. Idaho argues the Biden administration overstates health care woes to undermine state abortion laws.

What "Federal health care law" are they talking about?

If it's tied to funding for Medicare/Medicaid, then they can at most remove funding.

If it's a criminal statute or something purporting to coerce hospitals then it's simply unconstitutional: absent Roe, Congress has no police powers over abortion.

This is why I don’t want a federal law banning abortion nationwide. If the Fed has jurisdiction to ban all abortions then it has jurisdiction to legalize all abortions.

There’s no such need for an emergency abortion. If the mother’s health is in jeopardy, doctors have historically been empowered to end pregnancies early but in that case the treatment includes efforts to save both the mother and the baby. The argument here is apparently the administration wants the mother to determine whether or not medical personnel may try to save the baby. That is a personal decision, not a medical decision.

if they pass soem kind of emergency abortion allowance, then you can bet the left will heavily exploit it as a loophole to get millions of abortions again-

giving the left even an inch means losing the whole hill over time to them-

One thing you can be sure of is that the Biden administration’s definition of emergency will be overly broad and basically allow for abortion on demand provided a physician has agreed there is a danger not just to the mother’s life but her health as well. The E.R. will be made to function as abortion clinics. The only difference being more tax payers being stuck with the bill.

What is an emergency abortion? Is that when a woman decides to have a late term abortion, but goes into labor unexpectedly and must have an “emergency abortion” to prevent natural childbirth?

Only the left could think of this.

They can't unless they decide a baby is a human with Constitutional rights and they won't. Neither will they find that elections are rigged. Pray for the return of the Savior because this corrupt government is about to enslave the world we live in.

That is a personal decision, not a medical decision.

It certainly is for the Doctor, if there are any moral ones left. You may not have noticed but the Medical associations have been pushing the Euthanasia dogma lately even worse the Docs are listening to their siren song.

A true emergency situation would be a ruptured ectopic pregnancy. No ER would be the place for that. Just wheel them to OR. I worked many years in OR emergency. I have cut clothes off patients near death in the OR in attempt to save life.

The left wants ER used for abortion on demand - paid for by American taxpayers Pray for our country.

I am not an MD, but other than an ectopic pregnancy, or perhaps a woman with a heart condition where pregnancy could indeed cause cardiac arrest etc... I really can’t think of. a situation where performing an abortion on a mother is going to be less risky than other actions.

Abortion is a risky stress inducing procedure...

I know there are MD’s here and I would be happy to hear what other situations where abortion would be medically indicated...

We all know that abortions for medical reasons or rape and incest are an insanely small percentage of abortions that were performed annually. I am certain there are indeed situations where abortion is medically indicated, but those are very very rare.
