The relevant part of the article is not clear. But I think shadowlands1960 is correct. Because the guy was charged with just a misdemeanor, the prosecutor evidently cannot ask for bail to hold him.

From the article:

Jeudy was charged with third-degree assault, a misdemeanor — meaning he’s not bail-eligible.

From another article, confirming release/no bail ...

He was charged with misdemeanor assault, meaning he’s not bail eligible. He will be released back onto the street, and that’s the part that has the victim and her family frustrated and afraid.

They love word games, don’t they? How about “he was arrested and remains in custody awaiting arraignment.”
