I can’t speak to MASS law, but. when I taught ‘delinquents’ at a ‘youth center’, juveniles din’t have to actually break a law to get themselves locked up. They just had to be ‘delinquent’ which could be interpreted as being on a seriously wrong track. In fact, at the time, most girls locked up had actually committed no crime at all, rather they were considered ‘out of control’.
Not saying that any of this is right. These boys will face more grief than if they had robbed a store or beat a teacher up at school.

I agree with you, how is the illegal.
But close reading is needed on my part. The article says they’re arrested for saying things. But one small part of a sentence indicates an actual crime.
“ The charges levied against the children include threats to commit a crime,…”
Threats are different than name calling and bad words.
The next part seems a bit more questionable: “…with two of them facing additional charges for interference with civil rights. One additional child is facing a witness interference charge.”

Blacks, even those of mixed race like Obama, can call each other the "N" word with impunity, but let a white man do it, and they'll lock you up.
