It would if there was a deliberate shelling of the civilian population, which there was not. The shelling, unfortunately with unguided Grad missiles, was between military forces on both sides. But even this was the result of the Russian invasion in 2014. Ukraine had every right to attack these Russian surrogates and to attempt to reestablish control over its sovereign territory. So again, your argument fails.
