SALINE COUNTY, Ark. – Deputies said an armed burglary suspect was shot by a Saline County man returning home Tuesday when he saw the suspect draw a weapon as he left the man’s house.

Officials with the Saline County Sheriff’s Office said deputies responded to a call of shots fired at the home in the 10000 block of East Sardis Road. When they arrived, the deputies said they found the homeowner, who told them he had called 911.

The man said he saw the suspect coming out of his house pointing a firearm at him. The homeowner then said he drew his own gun and fired at the suspect, identified by authorities as John Nutt of Little Rock, in self-defense.

Deputies said Nutt ran away from the home. Teams searched the nearby area and were able to find Nutt and take him into custody. Investigators said stolen property was found with Nutt when deputies located him.

Authorities said he was taken to a nearby hospital for treatment of non-life-threatening injuries. Deputies added that Nutt is expected to face charges including residential burglary and aggravated assault.

Officials with the sheriff’s office said the investigation into this shooting is ongoing but noted that at this time they did not expect the homeowner to face any charges.

if only the headline would match the story.

Luck has little to do with it.

He lives in Arkansas. He probably has an understanding of Arkansas law.

Great Britain and Australia deviated from the United States on weapons law 100 years ago.

The United States preserved the right to arms with the Second Amendment, numerous state constitutions, and the right to self defense.

Great Britain and Australia destroyed the right to arms in their law, starting about 1920.

California is an intermediate case. They preserved the right to self defense on your own property and in your home, but did not want to extend the right to arms to Chinese immigrants or Mexican-Americans, or Indians, so they did not include a right to arms in their state constitution.

And like all 70’s cop movies, keep a throwdown available at all times. Yes officer the suspect had a gun in his hand. Just saying, be prepared.

‘Leaving the home’ should make no difference to the law since the ‘suspect’ drew on the homeowner. I’d argue that it would make no difference even if he was fleeing and refusing to halt because he was carrying loot and fleeing the scene of a crime. Isn’t that the standard the FBI uses?

Second Amendment, numerous state constitutions

Yes, but Hawaii is ‘blessed’ with a Supreme Court which chooses to read the 2nd Amendment ‘differently’ and conclude there is no right to keep and bear arms.

Correct.

The Hawaii Supreme Court did that because they have lost at the Supreme Court level.

That’s only because the king of Hawaii would have wanted it that way, and they think that matters.
