Appeals court rules Jan. 6 defendant’s sentence unlawfully enhanced

A federal appeals court on Friday ruled that an enhancement charge used against Jan. 6 defendants to lengthen their sentences couldn’t apply to the Capitol protest.

In a unanimous opinion from the D.C. Circuit Court of Appeals, Judge Patricia Millett, an Obama appointee, said prosecutors’ use of a “substantial interference with the administration of justice” charge to enhance the prison sentence of Larry Brock was too broad.

“We hold that the ‘administration of justice’ enhancement does not apply to interference with the legislative process of certifying electoral votes,” wrote Judge Millett....

The ruling could affect other Jan. 6 defendants who have faced the same sentencing enhancement the appeals court now deems unlawful.

True, but what about those who have been in jail for years already?

I want them to sue the government for billions and then once Trump becomes president for him to direct the justice department to settle the law suits!

Out of their budget. One way to de-fund these guys. I’d rather each individual would have to pay personally for the damage they’ve willfully done, but that isn’t going to happen.

They’re just doing this now because they know their side will be rioting in 2025 and don’t want the same non-standards of justice to be applied to them once Trump is elected.

exactly, and as we have learned from the left, the president can simply “settle” ANY case for ANY amount without the congress having to approve the funds!

So conservatives need only sue the government once Trump wins

Well, I’m sure the endless array of DC scumbags will have any number of additional crimes thaty can prosecute to keep the MAGA patriots jailed.

It appears that there is nothing easier to accomplish in DC.

The verdict should include an “enhanced amount” (ie generous) because of the trauma caused by false and overly harsh sentences-

I don’t. I want them to sue the individuals on the J6 committee and all parties involved in this grave injustice. There has to be accountability here and not fall to the taxpayers.

Maybe. Maybe the 3 or 4 Trump appointees, though not completely changing the makeup, it’s still a small Dem majority, made a difference. Heck, maybe they all made a good decision, I didn’t see a vote reported.

Should the Supremes rule a President is subject to criminal (civil too?) action over official actions you could see an awful lot of that. Has illegal immigration contrary to previously enforced laws caused any damage? Any criminal actions, like rape or murder?
