State of Texas: Ruling sparks Paxton’s push to oust conservative judges on Court of Criminal Appeals

Texas Attorney General Ken Paxton is not on the March Primary ballot, but he’s been active in the race, campaigning around the state for Republican candidates challenging some House members who voted to impeach him.

But Paxton is also mounting a different campaign effort that could have a more significant impact.

He is backing challengers to three Republican judges who currently serve on the Court of Criminal Appeals, the state’s highest criminal court. It comes after those judges ruled the Texas Constitution prevents Paxton from prosecuting voter fraud cases.

In an interview Wednesday, Paxton called the decision “ludicrous” and urged voters to elect new judges to the court.

“So the voters now have a decision. Do you want voter fraud prosecuted or do you not want it prosecuted?” Paxton said. “If you want the laws that are passed by the legislature followed, we’re going to have to have Gina Parker, Lee Finley, and David Schenck elected statewide to overcome this decision.”

Sharon Keller is no liberal. After 24 years presiding over Texas’ highest criminal court, she has earned a reputation as a tough-on-crime conservative — a staunch supporter of the death penalty with consistent endorsements from several city police associations. And yet, she and two other conservative judges on the Court of Criminal Appeals are the latest targets of Paxton and his allies in the Trump family.

The Texas Tribune is a far left source. Consistently biased against the Constitution, Second Amendment, and the rule of law.

The idea that the Texas AG cannot prosecute vote fraud cases, because he is in the executive branch of government is insane.

If that is true, Attorney Generals cannot prosecute any crime. Utterly insane.

Can you believe it. Paxton is going after good conservative Republican judges. Good conservatives like Dade Phelan. In other words Good 'ol boys who hang out with the Bushes.

I trust Ken too. However, Robert Pratt was telling about this Schenk guy having major support from Salem Abraham who wants to move our elected judge system to an appointed system.

I know that elections bring moneyed people to try and sway opinions but I also don’t like appointed judges who have no accountability directly to voters. I guess there are no perfect systems. But this is Pratt’s objection to Schenk. Pratt, a very conservative political commentator, pointed to the Dallas morning News story as being pretty fair in talking about Schenk. I am still unsure which way to go on Keller v Schenk. I will pray for clarity which way to go. Right now, I am ready to kick them all out. For sure the other two justices.

Yes, I didn’t understand that either. Prosecution is generally an executive function. But I’ve never read the Texas Constitution (and probably won’t, not my interest).

Having read pretty much all of John Adams’ governmental theory, I somewhat agree with appointive judges since it allows them to be insulated from the prevailing winds of the time (that’s the point of an independent judiciary). But I agree with you that, since impeachments have been rare, accountablity of judges is a problem.

I think a constitutional solution, (for states that have appointive judges), would be a specific term, limited terms of office, or some kind of reconfirmation process after a certain period.

The Texas Tribune is so far left that while driving, their employees will make three left turns around a block in order to avoid making a single right turn.

Unfortunately the San Antonio Excuse for News also has such employees.

Correct, though I see their drivel posted here from time to time from people who presumably aren't aware of their radical leftist slant. OTOH, this appears to be a good (not biased hard to the left) source for Texas news:
