Discharge petition could be used to get round conservative blockade of foreign aid bill

Lawmakers could force the supplemental to the floor through a discharge petition, which requires support from a majority of the chamber — meaning bipartisan participation. Democrats have a “ripe” discharge from last year’s debt limit showdown that already has 213 signatures. Five more would be a majority of the chamber.

Some progressive lawmakers, though, are likely to remove their names from the petition if it is used to move the foreign aid package in protest of the inclusion of aid for Israel without conditions. That would mean more Republican signatures are needed — a heavy lift since signing a discharge petition while in the majority is a significant swipe at leadership.

Sens. Thom Tillis (R-N.C.) and Markwayne Mullin (R-Okla.) said they have spoken with House lawmakers about using a discharge petition to move the foreign aid bill, according to news outlets.

Article I, Section 7, clause 1, of the U.S. Constitution is known as the Origination Clause because
it provides that “All Bills for raising Revenue shall originate in the House of Representatives.”

SCOTUS killed that provision of the Constitution after an origination lawsuit was filed when the Senate gutted via amendment a House tax bill called "Service Members Home Ownership Tax Act of 2009" and replaced the entire contents with Obamacare. SCOTUS denied to hear an appeal of the Appellate Court's affirmation of a District Court's dismissal of the case. See Sissel v. United States Department of Health & Human Services.

Democrats in the Senate used an innocuous tax bill (that exempted uniformed military personnel from certain tax provisions for first-time homebuyers) as a shell to get around the origination clause of the Constitution. SCOTUS dismissed the lawsuit, effectively giving the Senate revenue-raising power just like the House.

Another avenue of attack, would be to refuse to pass any bills until Biden is checked for competency using the logic a judge would with and Alzheimer patient who suddenly signs a will leaving everything to a stranger. non compos mantis and unable to legally sign a contract or Bill

There is a lot that I don't recall going on with the Constitution right now.

The courts were afraid of going against the "first black President" with Obamacare (recall the Chief Justice deeming it a tax after the White House testified that it was NOT a tax) and now they are afraid of a second Donald Trump presidency.

I say this somewhat facetiously, but there is some measure of solace in that the court always seemed to go extra-constitutional in only one direction. That suggests that they aren't "totally" rogue, but merely influenced by extreme pressures which only seem to come from one direction.

That may be changing now that President Trump altered the majority of the court. The lower courts are still doing the left's bidding, but SCOTUS is moving back to the right (or rightward to the middle). The problem is that a lot of damage can be done between the time of liberal rulings and when SCOTUS can stop it.

This is probably why they are coming down so hard on Trump, because they know the next President will have several Supreme Court nominations coming.

That's an interesting idea. Claim that the President isn't competent enough to understand the implications of signing or vetoing a bill, so refuse to pass one until the competency can be determined.

The biggest problem is the congress accepted the premise that the USSC has those powers bunt a new congress can reject that idea.. The Kelo v new london decision actually changed the wording from “public use” to “public good”

Yeah, I've been railing against that one for years.

Not only did they change "public use" to "public good," they did it on a bet. There was no guarantee that the project would even go forward when they made that ruling, and the project ended up getting canceled.

New London, CT ended up with no property tax revenue at all.

I used to tell the story of the second season of Donald Trump's The Apprentice. They introduced a new twist called "immunity" where the winning project manager was immune from being called to the Board Room if he was on the losing team in the next challenge.

The first winning project manager was on the losing team the next week, but was also one of the reasons for the team losing that week's challenge. Trump said he had immunity and could go back to the suite but the guy said he would waive immunity and stay with his team. The losing PM picked him to go into the Board Room, and subsequently Trump fired him.

Trump said that he fired the guy for giving up his immunity because he took a "sure thing" and turned it into a gamble.

That's what the city of New London did when they wanted to blight an existing neighborhood to use eminent domain to seize their property and turn it over to Pfizer to build a new office complex with higher property taxes. They took the sure thing of a constant property tax revenue stream and turned it into zero revenue.

And SCOTUS supported it.

We allowed them to lock us down, mask us, restrict our travel and shut down our lives, they know we will let them do anything. Elides, trumps cares act gave them ,ail in ballots so they can keep the tyranny going.
Maybe we will have a generation that will stop this… but our country was ended during covid. This is just the last embers dying out.
And it died under a Republican because they know you would not have been locked down under Biden or Obama.

I saw on twitter last night that there is something buried in the bill that prevents Trump from doing something if he gets reelected as POTUS.

Can’t find it - banned from twitter and can only read a few articles per day - but there is something very alarming in that bill. Congressional Rs know about it and are spreading the word.

It’s like dragging a steak past a pack of junkyard dogs. What fraction of that bill goes straight into the pockets of the deepstate without touching anything that looks useful. Must be at least half. Maybe 2/3. Maybe the GAO could do an audit and see where it actually goes - oh wait, GAO works for the same guys who are so hard over on this atrociously ridiculour bill.
