Prior restraint means they can’t stop you from publishing it. They didn’t come after her here until she published.
Still a violation of her constitutional rights. Just not prior restraint.
I’m not arguing that other of her rights were not violated. What I am arguing is that the law in question is a form of prior restraint. It is against Texas law to ask the government a question. If you can’t ask the question, you can’t obtain and publish the answer. It is the functional equivalent to prior restraint.
This law has never been used to prosecute anyone, ever. It was certainly retaliation. Many rights of hers were violated and there is no question that publishing in a blog for profit is not different than publishing in Hustler magazine; meaning no matter how mean or vulgar the story may be written, it is still protected.
