If the claim is based on fraud because Trump knew there was no fraud in the vote, then his defense would be to introduce the evidence of fraud in the vote upon which he made is representations. Other cases (there are many) have dismissed the claims of fraud based on a lack of standing for the accuser. Trump has standing to assert it as part of his defense.

If the case is thrown out because Smith had no authority, then the evidence of the fraudulent election will never see the light of day through its introduction as evidence in Trump’s trial. The merits will never be reached.

The public will continue to deny fraud in the election.

• A brand-new Washington Post / Univ. of Maryland poll: "Americans of every political demographic seemingly have more doubts about President Joe Biden’s legitimate ascent to the White House. According to the poll, just 62 percent of Americans, including Democrats and independents, believe the 2020 election was legitimate—down from 69 percent in 2021. Republican belief dropped the most, though, falling by eight points in the last three years to just 31 percent in the most recent survey.
