Strictly speaking, no candidates are actually on the ballot. The Framers intended the people to vote directly for Electors to the Electoral College who were known to them. The Electors are then free to vote for whomever they wish.

That's why Presidential candidates cannot be banned from ballots, because constitutionally they aren't on the ballot. That's also why Presidential candidates are excluded from the 14th Amendment, because they are technically not on the ballot.

In fact, Trump did have a trial (incitement of insurrection) which commenced on February 9, 2021, and concluded on February 13, 2021, with his acquittal. The Senate voted 57-43 to convict-10 votes short of the 2/3 majority to convict.

Both are extreme left-wing liberal political activists and are not acting as lawyers since neither brought into the discussion the 1872 Amnesty Act that repealed that 3rd section of the 14th Amendment they quoted. Don't forget, a law degree is a liberal arts degree. Lawyers are morons.

14th Amendment, Section 3.
Section 3. No person shall be a Senator or Representative in Congress, or elector of President and Vice President, or hold any office, civil or military, under the United States, or under any state, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any state legislature, or as an executive or judicial officer of any state, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof. But Congress may by a vote of two-thirds of each House, remove such disability.

1872 Amnesty Act, repealing the 14th Amendment section 3:
"Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled (two-thirds of each house concurring therein), that all political disabilities imposed by the third section of the fourteenth article of amendments of the Constitution of the United States are hereby removed from all persons whomsoever, except Senators and Representatives of the thirty-sixth and thirty-seventh Congresses, officers in the judicial, military, and naval service of the United States, heads of departments, and foreign ministers of the United States."

The 14th Amendment’s insurrection clause was nullified later anyway by the 1872 Amnesty Act. They might as well put people in prison for drinking due to the 18th Amendment (hoping people forget the 20th Amendment nullified the 18th).

If the SC overturns this ruling, both Luttig and Lawrence Tribe should be facing the same treatment as John Eastman - disbarment.

What is becoming apparent to the masses is that courts aren't following law. They are just making things up based upon their own personal point of view. To them, everything is malleable to their opinion. Our court system is in need of reform, and many judges should be removed by impeachment for violating very basic and fundamental rights.

If Trump’s call for a peaceful demonstration is an act of insurrection that bars him from the ballot, then Biden’s statement, “thus, in setting an American agenda for a New World Order, we must begin with a profound alteration in traditional thought” could also be considered insurrection.

Where are the charges that the Colorado electors for Trump engaged in insurrection against the US Constitution? Lefttards say Trump did, Trump did, however, in this case, this clause can only be used against presidential electors, not the actual candidate. This means that the electors must have engaged in insurrection, not the actual candidate.

Totally agree. While the Colorado judges are immune from the Congress, most of the tampering DC circuit should be in the crosshairs of the House. Reputations need to be sullied as a warning about bad behavior by other federal judges. Republicans aren't brave enough.

Going back to 2005 and 2006, this website was rife with articles about how great of a judge Luttig was. How the times change. (Or perhaps serving as Boeing's general counsel for 13 years changed some other things...)

Go easy on us. We even thought GWBush was going to be a good president. Time educates.
