When the threat appeared imminent, the FBI had to move in on the only charge that could stick for now: weapons charges. Sohaib Abuayyash, 20, was planning a massive terror attack targeting Jewish people in the Houston area. He had visited multiple gun ranges in the area and was trying to obtain instructions for bomb-making.
How Abuayyash was able to get firearms is a detail that will be revealed in time, but yes—he shouldn’t have been able to purchase or possess any firearm on a non-immigrant visa. That paperwork expired in 2019, but he’s been allowed to remain on American soil on a work authorization order through 2024. He's also applied for asylum (via NY Post):

“He has viewed specific and detailed content posted by radical organizations on the internet, including lessons on how to construct bombs or explosive devices,” FBI Director Chris Wray told the Senate Homeland Security Committee, though he declined to identify Abuayyash by name.

Private gun sales are still legal in Texas. This is an FBI operation intended to illustrate that and force new gun laws on America. Very likely the “Texan” who sold him the rifle was an FBI agent or informal acting under orders.

Meyerland in Houston used to be a beautiful and safe Jewish area. A couple years ago I went to Meyerland shopping center for something I forgot to bring as it is right off the freeway. Although I love Mediterranean food, I saw that the center across the street had mostly that to offer. While shopping I was in the minority- no hijab, even the clerks wore them!!!! No one smiled that I remember.
After lunch, I was frightful getting onto the street as it was like the area of Israel they live! I guess they cannot read signage so they drive as they want. I saw a lady in a dodge van go the WRONG way in a median to make a uturn!!!! I wanted to sit there and watch the craziness and their anger play through.
Now, Houston has their worship centers and is a hub of illegal immigration so you take your life in your hands alone shopping.
