We actually get the 1st Amendment wrong. Its provision is only applicable to the federal government (Congress). Additionally, Congress is not simply prohibited from passing a law establishing religion. Rather, it is prohibited from passing any law regarding the establishment of religion; i.e. it cannot pass a law establishing religion, nor one prohibiting the states from doing so. In other words, it takes the question of religion away from the federal government and reserves it to the states.
