This flies in the face of the civil rights act.

This is why no startup should go public on the Nasdaq. They will fight you to destroy your company.

P.S. I do not own Nasdaq stocks of any kind because this racism by Nasdaq wasn’t the first act of them destroying companies.

Hey, no problem. Just find a transgender, mentally incompetent, person of color that has a PhD in gender studies and you’re all set.

Me too, but the left hold all the power and can do whatever they want with impunity (ie they control cops, fbi, federal agencies, the news media (who cover for the left like good little lapdogs), antifa and blm, courts, judges, federal judges etc. They don’t have to live by the ‘laws’ that they impose on us.

Does Nasdaq have any other rules, standards, or requirements for companies to be listed on their exchange, or is this the only rule implemented by Nasdaq?

If the law contains the option of “explain why not”, then just grow a pair and do that.

A board is not a group of randomly chosen clowns intended for piccies in the financial reports.

Board members must be experts in at least one field critical to the company.

So— there ain’t enough competent folks available. That is why.

Would you find it hard to tell a nominee that they aren’t good enough? Well, then YOU don’t belong on the board.

"I’m guessing the court’s reason is the Nasdaq is private and listing is voluntary."

If it's not in the Constitution; isn't this a "States Rights" issue?

"The Tenth Amendment (Amendment X) to the United States Constitution, a part of the Bill of Rights, was ratified on December 15, 1791. It expresses the principle of federalism, also known as states' rights, by stating that the federal government has only those powers delegated to it by the Constitution..."

honestly, based on the penalty, I was imagining something VERY horrible, like a deliberate kick or breaking someones leg over your knee or something.
