The political matter doctrine and the First Amendment are arguments in favor of an appellate court overturning the gag order. Of course, the real issue is that the reason for the gag order is that Jack Smith and the Department of Justice realize that one of the ways that Trump advances politically in spite of the indictments is by not meekly accepting them and trying to win at trial and on appeal is by criticizing the indictments, the prosecutor, the Department of Justice, and even the judge.

Jack Smith knows that against most defendants and especially against political figures, he can use even an invalid conviction that is gained in bad faith and near certain to be overturned to ruin them. Two though can play that game. In truth, Smith and Garland and an entire tier of intermediate DOJ figures and line prosecutors should be investigated and impeached even if the US Senate will not convict them.
