President Trump on Thursday moved to dismiss Special Counsel Jack Smith’s DC case, citing ‘presidential immunity.’
Last month Trump was hit with 4 counts in Jack Smith’s January 6 case up in DC: Conspiracy to defraud the United States, conspiracy to obstruct an official proceeding, obstruction of and attempt to obstruct an official proceeding, and conspiracy against rights.
Jack Smith is also using the DC case to gag Trump.
The special counsel’s prosecutors accused Trump of attempting to “prejudice the jury pool through disparaging and inflammatory attacks on the citizens of this District, the Court, prosecutors, and prospective witnesses.”
Trump’s lawyers blasted the Biden Regime and accused Jack Smith of “breaking 234 years of precedent” for charging a former president.
“Breaking 234 years of precedent, the incumbent administration has charged President Trump for acts that lie not just within the ‘outer perimeter,’ but at the heart of his official responsibilities as President,” Trump’s attorneys say in their filing. “In doing so, the prosecution does not, and cannot, argue that President Trump’s efforts to ensure election integrity, and to advocate for the same, were outside the scope of his duties.”
Trump’s lawyers also argued that Trump has immunity based on his acquittal in the Senate after his second impeachment related to January 6.

Appeal all the way up to the Supremes with an emergency appeal. They need to be forced to address this. If ever there were a case REQUIRING them to address it, it is this.

The President of the United States just said he has a right to counteract fraud. If the hyper partisan biased frauds of the DC Circuit and their fellow travelers like “Smith” think they can override that and drag a President off in chains on flimsy “conspiracy” charges, they need only look at what is happening in the House to see how much more rope they have to go on these hail mary moves of theirs.
I can already hear the Dept. of Jesters practicing saying, “No way, Jose.”
Anything that favors Trump simply won’t happen in the “justice” system
This prosecution is both arbitrary and capricious, given that neither Hillary nor Algore (who was in Vietnam, and invented the Internet, in case no one knew) were ever prosecuted for challenging their respective losses.
Apparently, the only elections that can be challenged without fear of prosecution are the ones in which Republican candidates win.
If he is made Speaker, he just Subpoena’s Jack and the Judge to testify before Congress on the validity and legal meaning of the Presidential Immunity Act, then He JAILS THEM for CONTEMPT until the end of the Congressional Session

They all knew Russia collusion was a hoax and for 3 years they used it in an attempt to remove the POTUS and his administration all organized by the career criminal who is above the law Hillary F. Clinton who to this day still refuses to take responsibility for losing 2016 because she refused to campaign just like Joe did.
