A former Ministry of Defence police officer has won a discriminations case after she was sacked for failing the bleep test exam.
An employment tribunal ruled that the multi-stage fitness exam, which sees participants run back and forth at increasing speed, did not take into account 'innate biological differences' between men and women.
Koren Brown, 33, was successful in arguing she was a victim of unlawful discrimination after she failed to meet the force's fitness standards and was subsequently fired.
During the grueling fitness test she scored just 6.7 instead of the required 7.6.
She continued to be deployed in Scotland in April 2017 but after repeatedly failing attempts at the test was dismissed in October last year.
The College of Policing found that the officer had been 'indirectly discriminated against' on the ground of sex, when other alternative tests could have been made available.
In a landmarking ruling, the tribunal found that while police officers need to reach a certain fitness level, female officers may find the goals harder because of their biology.
Expert witnesses, who spoke during the case, said biological differences include women having smaller hearts, a higher percentage of body fat and a lower muscle mass on average.
Jillian Merchant, who represented Ms Brown, said the ruling shows employers that 'biological and physiological differences between men and women' need to be considered.

So much for requiring that they be equally qualified.
This is why I don't mind trannies invading women's sports. If women invade males spaces (e.g., police, etc.) for which they are not qualified, it's only fair that men invade female spaces.
I guess police departments will start hiring trannies to fill their quotas of female officers, if they’re not already.
This ruling is problematic for those who contend there are no biological differences between the TWO sexes.
The Tranny Left says it's not an unfair advantage if men want to compete in women's sports.

It used to be sexist to point this out. Now they cite it as unfair if you DONT accept it. People not to mention other cops are dead now because unfit females were in place to underperform at a critical moment. The dying will continue.
