Judges don’t file charges. Except of course for Judge Sullivan, in the Flynn case.

Depends upon how you interpret the law. The progressive judges believe you have to let them in and let them file their claim that they’re being presecuted in their country of origin. Trump claimed that since they were now in Mexico, they couldn’t be persecuted in their home country.
Many judges presume, with minimal proof, that they deserve their appearance in front of a judge to make their claim. They would rather let hundreds with no viable claim in rather than denying one with a legitimate claim.
The other reason is there are huge amounts of money involved. The cartels are charging thousands of dollars for each illegal they transport across Mexico and infiltrate into the US.
