I read a study our HR guy had. I don’t think it was “published” in the mainstream press. It wasn’t on glossy aper, it was just a few stapled sheets. It had to be from a specialist company that tries to warn companies about potential liabilities. Some of the things I recall, the single largest indicator you were hiring a potential lawsuit was if he was “of color” and a Democrat. Of color employees were particularly expensive as the government would provide them with a lawyer if they felt discriminated against. This particular company had a policy of fighting every lawsuit even if they knew they’d lose. They had a general settlement of less than ten thousand. They’d spend many times that fighting, though. The next most likely to sue was a white Democrat. The least likely to sue was a white Republican. The Independents split about fifty/fifty.
I think the reason Republicans don’t sue is, an unhappy Republican simply finds another job. If a Democrat is unhappy, then “somebody” has to pay. In my 33 working years, I left a couple of employers where I was unhappy. I can’t imagine wasting my time in court. The one time I thought it might be worthwhile as the situation was ridiculously egregious, a lawyer told me, “You probably have a winning case. If you were ‘one of the protected class,’ I’d take it in a heartbeat. But you’re white. The bill will be more than you could possibly win. I’d give this one a pass.”
