I am not arguing with the spirit of your post, but none of the Confederate leaders (with the exception of the commander of the Andersonville prison) were actually convicted of anything, so conviction is not required for disqualification under the 14th Amendment.

The difference being that they (Confederate government officials and military officers) who had previously sworn an oath to the Constitution had quite publicly served a government which had made war against the United States.

To say that Trump, by his actions or inactions, somehow staged an ‘insurrection’ against the government of the U.S. is absurd, but that is what the democrats have been seriously claiming for the last 2 1/2 years. I have no doubt that where they control state governments they will do their best to ‘disqualify’ President Trump from running for office.

It is fascinating to me to think that the people who endured the bloody Civil War were much more conciliatory towards the South—Congress restored rights for nearly all ex-Confederates—than the current crop of democrats.

By this standard, states with Republican governors and legislatures can force Biden off their ballots using unproven accusations of high crimes and misdemeanors. Either the legal system laughs such attempts to keep Trump off the ballot out of court, or we descend into the maelstrom.
