Federal judge tosses RNC’s case against Google for sending fundraising emails to spam

A federal judge in California threw out the Republican National Committee‘s lawsuit against Google that accused the tech giant of illegally sending party fundraising emails to users’ spam folders.

In a 38-page ruling, U.S. District Judge Daniel Calabretta, a Joe Biden appointee, granted Google‘s motion to dismiss, thereby putting at least a temporary end to RNC claims that Google must compensate it for hundreds of thousands of dollars in lost donations. Calabretta noted in his dismissal, however, that it was a “close call,” and said that the RNC still has the chance to file an amended complaint.

RNC Chairwoman Ronna McDaniel said that the committee sued Google because it was “committed to putting an end to this clear pattern of bias.” However, after a hearing, Calabretta ruled that Section 230 of the Communications Decency Act — a federal law that has drawn harsh criticism, particularly from many conservatives for its function of shielding online platforms from lawsuits over third-party content — shielded Google from the claims.

McDaniel reacted to Thursday’s ruling by doubling down on claims that Google has demonstrated illegal anti-conservative bias.

If Google is de facto CIA, then any electioneering would be a violation of the Hatch Act, so Section 230 doesn’t apply?

So, people pay money for the ad to appear. Google send it to spam. google sells space, then doesn’t let the customers ad appear? The judge is fine with that?

I’d say in this one case, if Google did what the RNC is accusing them of, they did us a favor. Saved me the trouble of manually deleting their fundraising emails.

This is what was coming if Cankles had been elected in 2016.

Everywhere conservatives turned, there would be a Clinton/Obama/Cankles stooge-"judge" laughing in their faces as they ruled against us.

Trump delayed the inevitable for four or so years [many Rapin Bill/Obama senior stooges put off retirement until after the 2020 Steal].

I am kinda glad the court ruled against the RNC.

I have grown weary of the Republican Politicians and the RNC, who are selling those email lists, to any candidate.

I am in Florida and in 2020 I was receiving email solicitations from GOP candidates in Oregon and Michigan.

When I receive a political email, I immediately hit the ‘unsubscribe” button and it seems to work as I get very few GOP ‘money begging emails’ today.

Something I have asked every single time this story comes up: Are these unsolicited requests for campaign donations? If so they are absolutely spam and Google is practicing great customer service by filtering them out.
