Federal judge comes out swinging against DOJ special counsel in Trump classified docs case

The federal judge overseeing the classified documents case against former President Donald Trump delivered multiple blows to Special Counsel Jack Smith’s efforts in a brief Monday.

Judge Aileen Cannon of the Southern District of Florida — who is presiding over the case that stems from a Miami grand jury’s June indictment of Trump — denied the Department of Justice’s (DOJ) request for sealed filings, striking two from the record. Cannon also requested additional information from prosecutors about the continued use of an out-of-state grand jury to investigate the case.

“The Special Counsel states in conclusory terms that the supplement should be sealed from public view ‘to comport with grand jury secrecy,’ but the motion for leave and the supplement plainly fail to satisfy the burden of establishing a sufficient legal or factual basis to warrant sealing the motion and supplement,”Cannon wrote in the brief, denying the DOJ’s request.

“Among other topics as raised in the Motion, the response shall address the legal propriety of using an out-of-district grand jury proceeding to continue to investigate and/or to seek post-indictment hearings on matters pertinent to the instant indicted matter in this district,”she continued in the brief. …

She appears to have gone straight to the heart of MadJack’s incredible arrogance by pointing out the conclusionary nature of everything he writes.

Apparently he’s used to getting away with this crap on home turf in DC where the judges basically answer to him.

And for a woman born in Colombia, she appears to have significant command of esoteric English far exceeding a lot of native born “judges” whose writing I’ve had the displeasure of reading.

Basically she’s got this guy’s number, and she’s going for the throat.

Maybe she doesn’t want to end up living in Colombia again. Had enuff of Turd World corruptocracies, not gonna let it go down here.

They used a DC grand jury knowing they’d get anything they wanted.....before transferring the case where it belonged all along (if it were a legitimate case), ie where the defendant resides - South Florida. You’re not supposed to do that. The grand jury is supposed to be in the same venue.

I love the Libs reaction of not accepting a judge’s ruling if they do not agree or like. They also look at laws the same way. Biden wants to forgive student loans but legally can’t, oh well he will and force others to sue to enforce the Constitution. Yet and here’s the irony of their position, they have charged Trump with all sort of ‘violations of law’ and they want Trump to be held to the standard of following a law but not them....

Isn’t a grand jury supposed to be in the district where the “crime” occurred? Smith, like the crooked slime he is, knows that he can get whatever he wants from a DC jury, and he also got a DC “judge” to strip Trump of his attorney-client privilege as well. A Florida judge probably wouldn’t have allowed that. The whole “boxes hoax’ should be thrown out, and Smith and his cronies be disbarred.

I doubt Smith would do something so stupid to compromise his entire case, but we will see. My recollection is that evidence (I am not saying an entire case) can be presented in different GJ. For instance, say you have a witness in Alaska for a case in Miami. Instead of bringing the witness to Miami, the evidence/witness could be presented to an Alaska GJ and the transcript could be used Miami...similar to a deposition. If I also remember correctly, many FBI labs are in Langly. Maybe they use this method for forensic GJ testimony? A specialist in Fed Criminal law would give a firmer answer.

She appears (to me...) to be laying the groundwork for dismissing the case with extreme prejudice.

Just my own opinion based on what I've read in the case thus far. Not an attorney, don't play one on TV and I didn't sleep at a Holiday Inn Express last night either.
