What you're missing is that none of President Trump's fellow primary candidates are covered by any gag orders. They are free to talk about the case all they want, especially on the debate stage.

Smith wants to set it up so that the Republicans bash Trump on the campaign trail, but if Trump steps over the line in responding he can haul him into court over violations of a gag order.

Basically, Smith want to manipulate the system so that Trump's Republican primary candidates do the dirty work for him.

if so, the next normal step should be for the judge either to have a hearing on the motion, or rule on the motion without a hearing.

Too late, the prosecution has already done this. Lots of judges and Prosecutors in the courtroom when Trump was indicted.

If this judge does not either recuse herself or allow the case to be moved outside of DC, then it goes automatically to appeal and gets overturned if the case is found against DJT...which it will be if allowed to go on in DC.

My prediction: the leftist “judge” will put a gag order on both the prosecution and defense. What this means in REAL life is that the prosecution will leak a bunch of lies to the media and Trump will be banned from speaking out.
