1. If Trump is acquitted (unlikely), it’s over for the prosecution because a defendant may not be re-tried on the same facts.

2. If he is convicted, Trump needs to argue that the Constution does not give prosecutors an unrestricted right to invent crimes and have them tried before biased jury pools. Otherwise, no candidate or office holder is safe.
