Felony Obstruction requires an underlying felony crime. Violating the Presidential Records Act won’t due because it has no punishment provision. So they probably will need to use the Espionage Act as relates to National Defense Information.
My argument (purely as a layman) is that, since before the adoption of the PRA, ex Presidents were allowed to retain documents related to their administration and that in the past, at least some ex Presidents retained National Defense Information, therefore that shows by historical precedent that ex Presidents are not covered by the Espionage Act.
Of course this is happening a day late, Hunter lost his plea deal yesterday.
