“Who wants to bet the “Supreme” Court punts and declines the case while acceding to slow motion totalitarianism?”


I wouldn’t take that bet. There are too many times where SCOTUS has ruled that “yeah, this actions seems a bit unconstitutional but there is not much we can do” if we take the government’s stated facts as the truth. That attitude is especially prevalent in issues regarding sovereign immunity, Fourth Amendment violations, and seizures of property without criminal charges.

Perhaps- for normal issues of American decline/ collapse into tyranny- but the 2020 election and related is a third rail of judicial survival. The USA is a post-legal polity at this point- it is not as if the SC matters in any meaningful sense- Biden ignored the SC ruling via student loan forgiveness almost immediately- there will be no blowback.
