If the Capitol hadn't been breached on J6, Ted Cruz had an agreement to have a bipartisan Electoral Commission formed to investigate election irregularities, just as had been done in the 1876 election.

That prospect, along with the numerous lawsuits that were still in play, it was not reasonable for even Pence to concede the election prior to the certification of the Electoral vote.

I doubt Cruz could have gotten bipartisan agreement for such a commission. Pelosi would never have let it happen.
