The Supreme Court really needs to get this one right.
There is no way this is not a budgetary allocation, and therefore there is no way that the president can do this on his own. It should be an easy decision for the sentient justices.
Exactly. If the President can pick and choose how government funds are spent, there's NOTHING they can dream up--they can spend funds on ANYTHING. Any cause at the moment where they believe it'll help them politically.
I suppose Roberts could reason that Congress appropriated the money for the loans, which satisfies the Constitutional requirement that the spending come from Congress, and that all Biden is doing is refraining from collecting the debt, which is not spending.
