Presidents use the bully pulpit to pressure private actors to do their will, whether John F. Kennedy to lower steel prices or Joe Biden to stop purported COVID-19 misinformation. Is that policy advocacy or unconstitutional coercion?
The 6th U.S. Circuit Court of Appeals, in oral argument Thursday, grappled with the consequences of arguably censoring the executive branch to prevent it from indirectly censoring Twitter users and whether the Department of Health and Human Services could legally remedy whatever actions Twitter takes against users.
The three-judge panel, all appointed by Republican presidents, seemed receptive to the argument that Twitter's sanctions against users got stiffer after public pressure from the White House, Surgeon General Vivek Murthy and other federal officials.

It will be very interesting to see how the Court rules. Are they going to rule that Twitter was censoring viewpoints anyway so additional pressure from government officials made no difference?
Therein lies the rub. The wording is Congress.

When Congress spends money to prohibit free speech, it should be regarded as effectively violating the 1st Amendment.
Also, the states have never expressly constitutionally given the very corrupt, post-17th Amendment ratification Congress the specific power to dictate, regulate, tax and spend for INTRAstate healthcare, including no power to try to stop the spread of diseases.

So the alleged federal government / Big Pharma-manufactured pandemic was arguably another ploy to unconstitutionally expand the fed's powers, just like unconstitutional Obamacare was imo.
Regarding 2024 elections, the next step is for Democratic and Republican patriots to primary as many of our beloved state and federal lawmakers and executives as we can.
After all, they have once again shown that that do not have the patriotism and leadership skills necessary to find legislative support for effective remedies for unconstitutional government policies.
Trump can endorse candidates that Constitution-savvy partiots recommend as long as candidates are not incumbents, candidates also promising to repeal the 16th (direct taxes) and 17th (popular voting for federal senators) Amendments after they win office.
The definition of insanity is reelecting your beloved career state and federal lawmakers and executives over and over again, expecting those same politicians to find remedies for unconstitutional government policies every time.
