Correct, if the predicate crimes are ongoing. If they are not ongoing, Federal Criminal RICO has a 5 yr statute of limitations (”SoL”). However, if the predicate crimes were intentionally hidden, then the court will allow “equitable tolling”, which then makes the SoL begin only after the crimes have been discovered. Federal Civil RICO is the same but the SoL is only 4 years.
