But the Republicans don't WANT to prosecute Biden. They want to prosecute TRUMP.
There's an old Soviet joke that applies:
American: "We have freedom of speech! I can stand in front of the White House and shout, 'Down with Reagan'"
Russian: "We have that, too! I can stand in front of the Kremlin and shout, 'Down with Reagan'".
Then Trump will be going to jail unless he appeals all the way to the Supreme Court and wins there.
Ask yourself, what chance at a fair trial would Trump have in Washington DC or NYC, and probably Atlanta.
