Indiana Attorney General Leads 18-State Lawsuit Challenging Biden’s Border Policies

Indiana Attorney General Todd Rokita is leading an 18-state lawsuit against the Biden administration over its handling of the border crisis.

The lawsuit specifically focuses on a new policy called the “Circumvention of Lawful Pathways,” which the Department of Homeland Security says intends to “expand safe and orderly pathways for migrants to lawfully enter the United States.” The rule was put in place following the expiration of Title 42 in early May and led to a massive influx at the southern border that the Biden administration has struggled to contain.

The lawsuit argues that the policy, which is also referred to as the Circumvention Rule, does not attempt to resolve the border issue but rather “tries to define the problem away by re-characterizing what would be illegal crossings as ‘lawful pathways.’”

[snip]

While the effort is being led by Rokita, the other states that have joined the lawsuit include Tennessee, North Dakota, Alaska, Mississippi, South Carolina, Arkansas, Florida, Idaho, Iowa, Kentucky, Virginia, New Hampshire, Utah, Wyoming, Montana, Missouri, and Oklahoma.

There are several states that I would expect to be included on those joining in with Rokita, but whose names are missing.

Wonder if this case will be dismissed for “lack of standing”?

I don’t see Texas on the list.

And I don’t understand why the Federal government can get away with not protecting the states from invasion as the constitution says they must. This is an invasion. Noone is suing based on that.

“I don’t see Texas on the list.”

Paxton’s name may have been on it but removed after he was impeached by the Texas house.

It wouldn’t surprise me, since Indiana isn’t on the border. That will be their logic.

Reason #1 Indiana is leading on this: Mike Pence is no longer Indiana’s governor.

Kabuki theater. Don't bother watching. Just the state giving the illusion of a credible resistance to what the state has no intention of fixing. Quite the contrary really.
